Membership Agreement

GAİN Membership Conditions

1. PARTIES

These Membership Conditions have been prepared to determine the procedures and principles regarding the membership conditions between GAİN Medya A.Ş. (“GAİN”) and the user who wants to benefit from the services to be provided by GAİN.

2. WHAT IS GAİN MEMBERSHIP?

GAİN offers a personalized membership service that allows its members to access content such as movies, documentaries, series, news, etc. over the internet via internet-connected television, computer, phone and all devices/methods that allow access to GAİN. Some GAİN content can be temporarily downloaded on various supported devices and watched offline. There may be restrictions, including the number of content that can be watched offline, the time it must be started to be watched and the time it will remain watchable.

3. MEMBERSHIP

3.1. After the person reads the contents of all these membership conditions in full, the membership process is completed by clicking on the "I Accept the Membership Conditions" button in the electronic environment and the acceptance declaration is recorded in the GAİN records. The member accepts and declares that he/she is informed about the basic characteristics of the digital content services subject to membership and all other issues in accordance with the relevant legislation and that these membership conditions are binding.

3.2. GAİN membership continues for a limited period determined by GAİN as long as the member's will to receive the service continues and complies with the membership rules. In order for the GAİN member to use the service provided by GAİN, he/she must have internet access and a device that supports the GAİN service.

3.3. In order to become a GAİN member, it is necessary to be 18 years old or to reach the age of majority valid in the region or country where the member is located. It is not possible for minors to become GAİN members and they must be under the supervision of an adult in order to benefit from GAİN services.

4. CHANGES IN MEMBERSHIP CONDITIONS

GAİN reserves the right to make changes in membership conditions. However, any changes made in membership conditions will be valid at the earliest 30 (thirty) days after notification to the member.

5. MEMBER RESPONSIBILITIES

5.1. The member accepts and undertakes to act in accordance with all applicable legislation while receiving the service and to comply with the limitations arising from legislation and terms of use in the purchase of this service. In this context, the member accepts that he/she will not reproduce, modify, distribute, exhibit, publish, mediate the publication of, process and reuse, produce, sell or rent other similar products, the content and information obtained through the service to be provided by GAİN - except through the means and scope permitted by GAİN. In addition, the member undertakes that he/she will not disable, modify or disrupt any of the protections created by GAİN. Any sharing by the Member regarding the content on GAİN is the Member's own responsibility and GAİN is not responsible for the Member's sharing in any way. However, the Member accepts, declares and undertakes that the publication of GAİN's content on other platforms, which provides services under certain conditions and in accordance with the Membership terms, may be contrary to the relevant legislation provisions, that it will not make any requests from GAİN under any terms and conditions within this scope, and that all responsibility belongs to it.

5.2. The Member will not use robots, spiders, scrapers or other automated means to access the GAİN service. In addition, the Member agrees not to decompile or disassemble any software or other products or processes accessible through the GAİN service; not to embed any code or product into the content of the GAİN service or manipulate them in any way; not to use any data creation, data collection or extraction method; The member agrees not to upload, send, e-mail or otherwise send or transmit any material designed to interrupt, damage or limit the functionality of any computer software or hardware or telecommunications equipment associated with the GAIN service, including any software viruses or any other computer code, files or programs.

5.3. As stated above, the member is obliged to act in accordance with all rules imposed on it by the current legislation. In the event that the member violates the above-mentioned and other obligations arising from the current legislation, the membership may be terminated and GAIN reserves all rights of claim and lawsuit regarding the excess, and GAIN has no liability for damages caused by the member to third parties.

5.4. The member is responsible for all transactions made through the GAIN account. In order to maintain control of the account and prevent others from accessing the account, the account owner
